The Australian Guide to Export Controls and Best Practices has been developed by the Export Controls Community of Practice Best Practices Working Group, in consultation with Australian Industry Group, to help Australian businesses navigate the complex landscape of export compliance.
 
This comprehensive resource is designed for Defence Primes, Small to Medium Enterprises (SMEs) and academic institutions seeking to understand their export control obligations and develop robust compliance programs. Created by experienced practitioners from industry and government, the Guide provides practical insights into Australian export control requirements and best practices.

Part 1 – General Information

Part 1 of this guide provides Australian entities general information about managing export-controlled goods and technology.

Part 2 – Embargoes and Sanctions

Part 2 of this guide provides an overview of the U.S. Office of Foreign Assets Control (OFAC) and Australian sanctions, embargoes, and corresponding best practices.

Part 3 – The Licence Free Environment

Part 3 of this guide provides an overview of the Australia-U.S.-UK Licence Free Environment and corresponding best practices

Part 4 – Australian Export/Import Controls

Part 4 is an overview of Defence Export Controls (DEC) and Australian Border Force (ABF procedures related to the import of certain goods)

Part 5 – US Export Controls

Part 5 is an overview of International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR)

Part 6 – Australian Best Practice

Part 6 provides examples of managing controlled exports and technology. It was developed through interviews and the solicitation of written submissions from compliance managers at Australian companies in the defence sector.

Part 7 – Useful Resources

While the Working Group recognises that resource constraints may make it difficult for SMEs and universities to implement complex compliance programs, we trust that Part 7 of this Guide will help to provide guidance on the essential elements of effective compliance programs, which can be scaled to suit a variety of budgets and resource constraints.

Many Australian exporters in the defence industry manage controlled technology that may also be subject to U.S. export controls, which have extraterritorial reach. As such, we have included in this guide basic information about the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR) and Office of Foreign Assets Control (OFAC) as well as best practice materials to assist Australian exporters, particularly SME’s, with compliance.
